1. Introduction
This website and online store are operated by South St Liquor Pty Ltd (ABN 33 653 453 671). βWeβ, βusβ and βourβ refer to South St Liquor Pty Ltd. By using our site or making a purchase, you agree to these Terms of Service.
2. Age Restriction & Responsible Supply
You must be 18+ to purchase alcohol from us. By ordering, you confirm you meet this legal requirement. Proof of age may be required on delivery. Supplying alcohol to a person under 18 is an offence. We support the responsible service of alcohol and comply with applicable state and territory liquor laws.

3. Australian Consumer Law (ACL)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure, you are entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the goods repaired or replaced. Nothing in these Terms excludes, restricts, or modifies your rights under the ACL.
4. Orders & Payment
Orders are accepted when we send an order confirmation. We may reject or cancel orders on reasonable grounds (e.g., suspected fraud, pricing error, delivery restrictions). Payment is required before dispatch.
5. Pricing & Availability
Prices are in AUD and include GST unless stated otherwise. Prices and availability may change without notice.
6. Shipping
We deliver Australia-wide using reputable carriers. Delivery timeframes are estimates and may vary. Risk passes on delivery to your nominated address (see Shipping Policy for details, including ATL and ID requirements for alcohol).
7. Returns & Refunds
We comply with the ACL. See our Returns & Refunds Policy for remedies, proof-of-purchase, and (optional) change-of-mind conditions.
8. Acceptable Use
You must not use the site for unlawful purposes; infringe IP; upload malware; attempt to gain unauthorised access; or interfere with security or operation.
9. Intellectual Property
9.1 Ownership
All content on the site including text, graphics, logos, trademarks, product images, videos, and code is owned by us or our licensors and is protected by Australian and international IP laws.
9.2 Your Limited Licence
We grant you a non-exclusive, revocable, non-transferable licence to access and use the site for personal, non-commercial purposes. You must not copy, reproduce, distribute, adapt, reverse engineer, mine, scrape, or create derivative works from any part of the site except as permitted by law or with our prior written consent.
9.3 Trademarks
βSOUTH AVEβ, our logos, and trade dress are our trademarks. You must not use them without our written permission.

10.1 Your Responsibility
If you submit content (e.g., reviews, photos, comments), you warrant it is accurate, lawful, not misleading or defamatory, and that you own or have permission to use it.
10.2 Licence You Give Us
You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish and communicate your submitted content in connection with our business (including on our site, emails and social channels).
10.3 Moderation
We may remove or decline content that breaches these Terms or applicable laws.

11.2 Responsible Consumption

11.3 Allergens & Ingredients
Where provided by manufacturers or required by law, we display mandatory statements/labels. If you have specific dietary or allergen concerns, check the product label and contact us before purchase.

12. Limitation of Liability
12.1 No Exclusion of ACL Rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other law that cannot be excluded.
12.2 Extent Permitted by Law
To the extent permitted by law (and subject to the ACL), we exclude all warranties, representations and conditions not expressly set out in these Terms.
12.3 Loss Types
To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profits, loss of revenue, or loss of data arising from your use of the site or products, except where such loss is required to be covered by law.
12.4 Cap for Non-ACL Claims
Where our liability cannot be excluded but may be limited, and where the claim is not under the ACL, our liability to you is limited, at our option, to re-supply of services, replacement of goods, or the cost of doing so.
13. Indemnity
You agree to indemnify us (and our officers, employees and agents) against losses, costs, liabilities and expenses to the extent they are caused by:
a) your breach of these Terms;
b) your unlawful use of the site or products; or
c) your infringement of third-party rights in content you submit,
except to the extent caused by our negligence, wilful misconduct, or breach of law. This clause is intended to be fair, reasonable, and compliant with the ACLβs unfair contract terms regime.

15. Changes to the Site/Terms

These Terms are governed by the laws of Australia. You agree to the non-exclusive jurisdiction of Australian courts and tribunals.

The South Ave mobile message service (βServiceβ) is operated by South Ave Pty Ltd (βSouth Aveβ, βweβ, or βusβ). Your use of the Service constitutes your agreement to these terms and conditions (βMobile Termsβ).
We may modify or cancel the Service or its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes constitutes your acceptance of those changes.
By consenting to South Aveβs SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of South Ave through your wireless provider to the mobile number you provided, even if your number is on any Do Not Call list. Text messages may be sent using an automatic dialing system or similar technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
Your consent is not a condition of purchase. Participation is voluntary.
We do not charge for the Service, but you are responsible for any charges imposed by your wireless provider. Message frequency varies. Message and data rates may apply.
To opt out, text STOP to South Ave or click the unsubscribe link (where available). You will receive a one-time confirmation message. No further messages will be sent unless initiated by you.

We may change any short code or telephone number used to operate the Service and will notify you accordingly. The wireless carriers supported by the Service are not liable for delayed or undelivered messages.
